I have been livig in my new house a year now. THe person who previously owned this home built behind the property (not on my property) a compost heap. It basically consists of some large stakes pounded into the ground with some logs forming the border.

I local farmer drove into it today. I could have cared less, I don't really ever use it and it is becoming an eyesore.

He came to my door and told me this was my fault and that I am required to clean this mess up, ( I assume he wants me to fix his tractor as well, broken lights).

I asked him, how I am responsible for this mess, I didn't build this compost heap, it is not on my land, and he shouldn't have driven into it in the first place.

He says because the person who previously own my house built it, I have inherited the problem.

He says he is going to the mayor.

We will see how this plays out.

I think in the spring I'll just beark up what left of the wood there adn drag it into the forest to rot.

____ Ah, Land possession by improvement, squatters rights. So by his logic he was trespassing on your property via improvements. This could get ugly depending on the judge.

But Ash can claim that he does not have squatter rights because he lays no claim to the property it's on, nor does he use the compost heap since he does not consider it his property. If you have anybody who can vouch for your attitude toward the compost heap I would certainly bring them into the picture.

wow, what a headache! Interesting case though, I wonder how far the farmer will get.

Back in Ontario, I hated living beside a farmer. He always thought my land was his since his grandpappy took a shit there once. [Mad]

Reminds me of the guy who backed into my stationary car - his first words as he got out of the car were

"You #@&%ing idiot, didn't you see me backing out?"

Some people think it's always the other guy's fault.

Hopefully, he'll talk to the mayor, the mayor will say "So, you crashed your tractor into a stationary object on your own land, and you think it's your neighbors fault because...?????" and that will be the end of it.

Same thing happened to me at a restaurant! A woman walked in and asked who had the black jeep. She then proceded to eyxlplainto me she didn't like where I parked and it was my fault she backed into me. A blind person could have backed her car out of her spot without hitting me.

She drove A lexus. She didn't have insurance. She told the police officer that she had left her Proof of Insurance at home, or in her other purse or someting. It was almost worth all that trouble to see the look on her face when the police officer, annoyed he was being lied to, told her that not having Proof of Insurance in the car is also against the law. She got a big ticket. ahh karma.

Say Nothing!

He will have to prove who created the mess on his property!

And you will rightly say that you do not know for sure. You were not there when it was built!

Have a great day!
