copied from another forum i posted on earlier and i'm too lazy tired and in pain to bother editing:

heading down I-95 on my way home from work about 5-ish PM

truck slams on brakes in front me me, so i do as well - problem is he comes to a dead stop or just about and i can't get slowed in time (i think my brakes suck)
so i try to move to the right side lane to avoid a hit since the left is blocked

BAM!!!

crap.

my left front gets crushed in by a S-10 rear right bumper - hood, frame, headlight assembly, fender, steering, windshield has 2 cracks = all toast
crispified you might say

so i think, well that's over with


BAM!!!

nope, i get tagged from BEHIND as well, by a F-250

instantly i feel a sharp pain in my neck and no i'm not playing that up
i ignore it and manage to drive off to the side of the road

call ins. co, call freind, call cops, etc and neck getting a bit stiffer and more painful - bfd i'm dealing with it
10 min later there's 3 fire engines and a cop blocking 2 goddamn lanes of traffic like everyone needs that during rush hour (other 2 guys had pulled over to the side as well by now)

special thanks to col_panic for coming around and taking pics (hey! where are they so i can post 'em?!) and convincing me to take a waaaaaaaaaaambulance ride to get checked out

the extra-special ride to the hopsital was more painful than if i had driven myself, as being strapped to the damn board and bouncing around wasn't helping my neck or lower back

so, get out of x-ray room at 6;03, exactly 3 minutes too fucking late to call and get a rental car for the day

of course before i leave the ER i have to find out who has my lic., since i gave it to an EMT so he could write up w/e he needed
a short FHP cop comes in and gives it back to me AND gives me a fucking ticket as well

what for? good question.
answer?? FAILING TO SIGNAL LANE CHANGE
i laugh out loud, and would be excpet my fucking neck is still hurting

so i ask the guy "if i hadn't tried to get out of the way and hit the guy full force and broke a leg i wouldn't have gotten a ticket right?"
he sez "yes"

i said this guy was short right? it took all i could muster to not slap this bitch down and just go insane on him, after all we're in an ER at the time, easy to fix him up later

by this time my neck is still hurting even after two vicodin(sp?) and i have a massive migrane and i can hardly see

cell phones don't work in hospitals, btw - something i didn't know

finally get out of the hospital and start making calls
since i wasn't asked and i DID leave instructions of where to tow my car and they were ignored, i now get to pay $129 for a hook up, $3.50 per mile x 10 miles, and $22/day storage fee
i can't even think about getting it until at least tomorrow, so add another $22, plus another tow for $129 plus $3.50/mi for roughly 14 miles to my place = i'm getting raped and this is only the start of it

come to find out that these two guys know each other.... starting to smell ins. fraud anyone?

yeah, so i get a voicemail and it seems at least one of these tools has the same ins. co i have

$30.50 cab ride home. yay. and the fucking driver let the meter run a little bit longer just to bump it up to 31.50 wtf
i jump in his face and tell him it's $30.50 cuz that's what it said when we stopped

no, stumble in cuz my head is about to explode and i can't see hit and spend the next 15 min trying to write all this up

so:
no car
no $
$700 or so in debt inside of 2 seconds
in pain
in middle of what's likely an ins. fraud case
oh yeah and only had bare min. ins on my car cuz it's so fucking expensive, so it's going to be totaled

i'm sure i missed some stuff and when i remember or someone asks a Q i'll edit/respond

That sucks man. Hopefully the insurance works out in the end. I don't know how much at fault you'll be found, but based on the pig's ticket, it doesn't look good. Hopefully in the end you get some reimbursement for all that crap.

That's not so bad.

My friend had to get cut out of her car after an accident over a year ago. She's still seeing specialists and arguing with insurance companies and only recently was cleared to go on a work rehabilitation program.

It could be worse for you. You could have developed a stutter.

I'm sorry that happened to you. It's an unfortunate and painful thing that happens to good folks like you. We've also had our share of bang-ups here in L.A., so I definitely feel for you.

I hope things are hashed out quickly and your pain goes away real soon.

I know car accidents of this sort are quite a pain to deal with, but look on the bright side - at least, you (and your car, for the most part) are still in one piece. Busted fender can be repaired, spent money can be earned, but I'm yet to hear about anybody successfully reattaching a severed head. See if you can find some witnesses, those will be quite useful when it comes to battling the insurance company for your money.

Cops give tickets at accident scenes because they can't think of anything else to do, especially after they've flagged off the traffice and helped the medics and firefighters lift people. A friend of mine ran her car off the road on a particularily nasty day last winter. She put in in park and jumped out before it really got going down the ravine she sent it down, so she was okay. The car also turned out to be okay. It didn't roll, it landed right-side up on an access road at the bottom of the ravine, and so the firefighters were able to simply go on down and drive it up to her. There was no property damaged either as she didn't hit any guard rails or any other cars in the process. However, none of this stopped the cops from giving her an very expensive ticket and some points on her license for something like "driving too fast for the conditions". Never mind she was going 20 miles under the posted limit...

Ouch! *hugs* I hope you feel better -ct-. Its days like this you need to sit down in a hot bath with lavender bubblebath lotion [Wink]

The car looks quite a wreck. I'm told that when a car is this damaged, the repair is enough to cover the cost of a perfectly good-working second hand car.

Anyway, I hope everything works out. Keep us updated!

No kidding. My little sister was in a car accident about 3 years ago that permanently messed her back up ... she got into a friend's car after one of her friends told her everything was cool and to just shut up and sit down. While that may have been a mistake, before she was even completely in the car and before the door was closed, the girl driving sped off... they got into an accident about 100 metres away from where they took off.. not giving my sister NEARLY enough time to put her seatbelt on (despite trying). The cop came to her hospital room after the accident and gave her a $150 ticket for failing to wear a seatbelt. Maggot.

well, let's see what i've learned from this whole thing so far

1, go FASTER and drive like you're in the indy 500 and you won't get into a situation like that when following like a stupid sheep

2, if such a situation arises again, do NOT attempt to avoid a collision other than using your brakes, even if it means you get a broken leg, arm, back or whatever - you'll at least be saved from getting a ticket that serves no purpose other than meeting a cop's quota for the day

2, be SURE that if/when you are hit you DO NOT leave the scene until YOU call a tow truck and tell them EXACTLY where you want your car taken, even if you're bleeding profusley with bones sticking out, otherwise you're paying through the ASS for towing, which is more painful

3, if offered medical treatment refuse it and get a ride from a passing car to the nearest hospital - it'll be less painful and you'll get there faster

4, if hit from behind, make damn sure you play up a neck injury no matter how minor it is - you'll get teh gooood drugs and probably a lot more $ when you file your case in court

5, your 1st call on your cell phone should be to a personal injury lawyer number which you have on speed dial, your 2nd call should be to your insurance co., 3rd to the media, 4th to a tow truck (see # 2 ), 5th to 911

6, be sure you have towing and rental car and collision coverage on your ins. policy - yeah it's expensive but so long as you have at least one "accident" a year it pays for itself

7, if you find out that 2 or more ppl involved in the accident know each other, scream out INSURANCE FRAUD loudly while holding your neck and at showing tears at the pain (from a nose hair you just pulled)


as i get screwed i'll add more points or revise these


the more often i get screwed the more cynical i become and the more i follow the rules down to the letter - that means if there's a loophole - I"M JUMPING THROUGH IT

i'll play your fucking game but don't bitch when i use it to my advantage, mr. the man

so anyway, my neck still hurts and now so does my left shoulder
i'm out roughly $470 just from towing and rental car so far
next week i pay rent, elec., i-net, and cell - what i have left over goes to a "new" car which will probably be less than 700 available, and since i can't get a car worth a shit for that price it means i have to finance
and since my credit sucks - i was JUST starting to get caught up and clear things - i'm forced into one of these shady "buy here pay here" dealers wich basicaly adds a thousand bucks to the price of whatever car i'm looking at
(700 down and ~240/mo or less for 36 mo. is what i can deal with)

Speaking as a former EMT, have fun getting the medics to let you sign off if you're complaining about neck and back pain. They can't make you go if you're legally competent to refuse (which most conscious accidnet victims are), but they can get very persuasive. There's two reasons for this. One, you could very well be one of those rare cases where there is a break in the spinal column and if you turn your head or twist your back around you'll end up in a wheelchair or worse. Two, letting someone complaining of neck or back pain sign off without putting up a major fuss is a HUGE liability for the medics. It's far easier to just talk someone into going than to write the call up word for frickin' word to protect yourself from a lawsuit and then go home with that raw taste in your mouth that comes when you were forced into something you regret.

Sorry to hear about it. Now, is anyone liable for you? As im betting, the ticket makes you liable for the guy you hit in the front. but is the guy in the truck liable for you, as he hit you?

Yeah, but he only hit CT cause he pulled out in front of him.

There are only a few circumstances in which one can both brake and swerve to avoid an accident. You must be willing and able to make a decision *instantly* and then follow through with it. I almost totaled the Porsche the other day, but thanks to a quick response I was able to swerve to the right and squeeze between two other cars. If I had braked I would've hit him (cause the car doesn't have "brakes." If I would've braked and swerved I would've been going the wrong speed to squeeze between the two cars. This all happened because I was following too closely, but thanks to a quick response (less than 1/10 of a second lane to lane) and a car that can corner like no other I was okay. Good thing too, because if I would've hit him at that big of a speed differential I definately would've totaled the car out and more than likely have killed myself and my passenger.
