Hearing that judgement has made me gay! [Big Grin]
That's right folks, I am joyfully light-heartly happy that the Canadian Supreme Court judges have ruled that the federal government's proposed definition of marriage as "the lawful union of two persons" would not violate our constitution.

"Lawful union of two persons" from the BBC News article referenced in the first post.

Does that include an uncle and his niece/nephew? How about a mother and her child? What about first cousins? If the Canadian powers-that-be are going to allow
"non-traditional" marriages, they need to use specific language or that ruling will be used to justify all kinds of unions, not just homosexual ones, potentially making null and void prior laws restricting close relatives from marrying.

Hmmm.... I can see it now--gay couples will "marry" and not have children, but the heterosexual couples who marry and have children will be so closely related that their offspring will have serious defects. Can anyone say "Natural Selection"? [Razz]

Don't know if you said that in a tongue-in-cheek way, but just in case not:

The previous definition was union of a man and a woman. That didn't exlude mother-with-son, father-with-daughter, sister-with-brother, etc. Still those were illegal - because the definition isn't the only thing defining the legality. Because the definition changes doesn't mean those other restrictions don't hold anymore. There's legality, and there's morality. The court just said that with recognition of homosexuality as a fact (and not a ugly mental disorder as some pretend it to be), gay couples should have the same recognition as heterosexual one - because our Charter of Rights and Freedoms says:
quote:
15. (1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.
Note the "in particular". That means that there could be more than what is listed. Sexual orientation was deemed covered.

And please tell me: do you see any problems with heterosexual couple who decide not to have children? How are they any different from homosexual couples? Oh yes: the latter may want to have children, so they may decide to 1) go through a surrogate mother/fater to have one, or 2) adopt a child.

Quite frankly, I'm getting a bit tired of those religious leaders who believe everyone should think the same as they do whether or not they are from the same religion. In Canada, separation of Church and State is a reality; we do not condemn people upon religious law. And Pierre-Eliott Trudeau, no matter how much I loath his arrogance, was right when he said that the state has no matter into what's going on in one's bedroom, as long as it's consensual.

By the way, the Supreme Court also said that churches were allowed to refuse to marry gay couples, so no one is forcing anything down anyone's throat.

Further to what Stereo echoed - the Religious Reich has forgotten something - Freedom of Religion also include Freedom _FROM_ Religion too.

(I do note that the atheist/agnositc types are much less troubled by the concept of homosexual marriage than the religiously focused)
